"6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" (ORGANIZED BY "TOW-IN SURFERS, LLC") LIABILITY RELEASE AND INDEMNITY WAIVER. THIS DOCUMENT REQUIRES SIGNING BY ANY AND ALL COMPETING PARTICIPANTS, EVENT STAFF, ALL MEDIA PERSONS, PHOTOGRAPHERS, VIDEOGRAPHERS, FILM-MAKERS AND THEIR CREWS!

I, the undersigned, acknowledge that tow-in-surfing, jet-ski driving and participation in and/or photographing of any Tow-In Surfing Event or related activity are hazardous activities and I have made a voluntary choice to participate in these activities despite the risks that they present. In consideration of my being permitted to participate in or film the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010", I agree to assume any and all risk of Injury or Death which might be associated with or result from my participation in or filming of the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010". I understand that this waiver holds harmless the State of Hawaii, DLNR/DOBOR, City and County of Honolulu, C+C Lifeguards, Dept. of Parks and Recreation, Aloha Surf-Lifesaving, the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" Staff , Co-Directors, Tow-In Surfers LLC, KeepTheOceanBlue.com, NorthShoreTowIn.com and any other sponsors, promoters, administrators, officials or officers of the above mentioned Event from any and all liabilities for injuries or damages whatsoever arising from my presence at, filming of or participation in the Event. I, the undersigned, have carefully read this agreement and all of it's terms. I understand that this is a release of liability which will legally prevent me or any other person from filing suit or making any of his/her legal claims for damages in the event of my death or any injury to me and/or in the event of my self causing any injury or death to any other persons participating in, filming or involved with this Event in any way. I also agree to conduct myself in a professional and sportsmanlike manner before, during and after the Event and any time I am participating in, filming, in the vicinity of, representing or acting in behalf of the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010". I agree that I will review all the rules and regulations of the Event and I will abide by any and all Event safety and/or conduct rules. I also agree that any unprofessional, unsafe or un-sportsmanlike conduct will be cause for my immediate disqualification from the Event at the discretion of the Event Co-Directors, Tow-In Surfers, LLC and any or all Officials, Administrators or Officers associated with the Event. (I understand that all entry fees are non-transferable and non-refundable unless event does not run and/or if a pre-paid alternate team does not get to surf.) I further agree that the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" Staff, Media, Co-Directors, Tow-In Surfers LLC, KeepTheOceanBlue.com, NorthShoreTowIn.com or any other EVENT SPONSOR who is present at the Event may photograph me on film or tape record my voice conversations and sounds at any time during and/or in connection with this Event (before, during and/or after this Event) for the purpose of promoting the event into perpetuity. I agree that the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" Staff, Co-Directors, Tow-In Surfers LLC, KeepTheOceanBlue.com, NorthShoreTowIn.com and/or any other event sponsors and/or any such subsidiary or affiliate of the Event shall retain video/audio exclusive co-usership rights with any media affiliate hereunder signed. My name, voice, likeness, event performance and any biographical material using myself as a part of this event may be used, published, displayed or copyrighted in any and every form, style, size, or color by the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" Staff, Co-Directors, KeepTheOceanBlue.com, NorthShoreTowin.com and any other of the event's sponsors,Tow-In Surfers LLC and/or it's subsidiaries or affiliates, their successors and assigns or by any other person, corporation or association duly authorized by the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" Staff, Co-Directors, Tow-In Surfers LLC, KeepTheOceanBlue.com, NorthShoreTowIn.com and/or any of it's subsidiaries or affiliates in complete cooperation with the various media representatives capturing my voice, image and/or performance without any restrictions or limitations whatsoever forever and throughout the world in all media including without limitations print, radio, motion pictures, television, VHS and DVDs when used in connection with the promotion or advertising of this Event or any future Events associated with the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" Staff, Co-Directors, KeepTheOceanBlue.com, NorthShoreTowIn.com and any othe event sponsors, Tow-In Surfers LLC and/or any of it's subsidiaries or affiliates, their successors and assigns or by any other person, corporation or association duly authorized by Tow-In Surfers LLC, Event Staff or Co-Directors of the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010". All Competing PWC Must Have A Current Hawaii DLNR/DOBOR Tow-In Surfing Decal And All Required Safety Equipment! If you have taken the Tow-In Surf License Class you are on the DLNR/DOBOR list and you can take your current Hawaii State PWC Registration and Tow-In Card to the DLNR/DOBOR OFFICE at #4 Sand Island Road to get your Hawaii State Tow-In Surfing Decal. ALL COMPETITORS MUST BE SIGNED UP AND PAID UP Prior to the start of Competition on Event Day! WE WILL GIVE ALL ENTRANTS AT LEAST 48 HOURS NOTICE IF THE EVENT IS ON A POSSIBLE "GO" STATUS!! If you do not yet have a Hawaii State Tow-In License, YOU NEED TO MAKE ARRANGEMENTS to take the class ASAP. THE TOW-IN SURFING CLASS IS HELD Weekends AT WINDWARD COMMUNITY COLLEGE IN KANEOHE, OAHU.
