The "6th Annual 'KEEP THE OCEAN BLUE' North Shore Tow-In Surf Championship 2009/2010"

"PHOTOGRAPHER'S AGREEMENTS with 'KTOB North Shore Tow-In 2009/2010' dba Tow-In Surfers LLC"

Any and all Photographers, Videographers, Sound Recorders, Film-makers and anyone else who would like to capture images, sounds, footage and/or any kind of visual or audible recordings of the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009-2010" are requested to sign this special "Photographer's Agreement" prior to recording the Event in any way. All Photographers and any other media as stated above are also requested to sign the "Sign-Up Page/ Waiver" as it is printed on the sign up page and turn it into "Tow-In Surfers LLC" officials prior to the start-up of the Event for reasons of liability in regards to attending a Big Wave Surf Event whether they participate on land, shore or sea in the Haleiwa Harbor Event . All Photographers and any other media as stated above are requested to also read, understand and sign this binding "Photographer's Agreement" prior to the start-up of the event and before recording images or sounds of the Event area by any means. This "Photographer's Agreement" requests that we at "Tow-In Surfers, LLC" are granted equal and non-exclusive rights to the use of any and all motion pictures, videos, films, stills, digital images, sound recordings and the like captured at the Event by any party for promotional purposes only in mutual cooperation with the signers of this agreement. We request the equal right to the non-exclusive use for promotional purposes only of any media taken at the Event of the Event itself or of any participants in the Event before, during or after the Event or at any time that they are representing the Event or it's sponsors in any way by mutual cooperation with the signers of this agreement. Any time that a media image is used of the Event or any of it's participants before, during or after the Event, we at "Tow-In Surfers LLC" request the non-exclusive use for promotional purposes only of any and/or all of those media images (stills, films, videos, sound recordings, etc.) anywhere in the world and in any format at all by mutual cooperation and consent of the signers of this agreement. Equally, we at "Tow-In Surfers LLC" willfully grant to the signers of this agreement the use of any and all media images in any format taken by any media of the Event or it's participants before, during or after the Event or at any time that it's participants are representing the Event or it's sponsors in any way. We at "Tow-In Surfers LLC" request the right to be made aware of any and all use of any media images recorded at the Event or in reference to the Event by any media in any format. We at "Tow-In Surfers LLC" request the equal and non-exclusive rights for promotional purposes only to the use of these images anywhere in the world and in any format with the Photographers or Media that are signers of this agreement and that capture these images of the Event or in reference to the Event. We at "Tow-In Surfers LLC" will first clear any such use of any media images of the Event or in reference to the Event with the media signers of this agreement who captured them. Likewise, any Photographers or Media who capture any media images of the Event or in reference to the Event, we would request that we are made aware of the use of these media images by the signers of this agreement's direct communication with "Tow-In Surfers LLC" prior to or concurrent with those image's media release. Use and access of and to these images not to be with-held by either party to this agreement from the other without good and clear explained cause or reason by the with-holding party (for instance, if there was anything contained in these media images that would be considered or deemed negative to "Tow-In Surfers LLC", the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009-2010", the Participants, Staff, Photographers, Media Representatives, Sponsors, Advertisers and Affiliates and/or the North Shore Tow-In Event itself or any subsequent media representation of the North Shore Tow-In Event 2009/2010. Also, if there is any hesitation by the signer of this agreement regarding the quality of the images, photos , videos or any other visual capture of the event or it's participants... the signer of this agreement may request that such images not be for used by the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In 2009/2010" for promotional purposes and we will honor that request. Tow-In Surfers LLC and the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surfing Championship2009/2010" requests that all signers of this agreement give photo credit to the photographer of each image or videographer of any motion images and that each individual image or sequence of images in stills, video or audio gives visual, audible and/or written credit on it or has captioning next to it identifying that it is from the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" and that it identifies the individual competitors, staff, sponsors and the like captured on the images or recordings taken of the event or relating to this event into perpetuity by the signers of this agreement. It is also agreed that the media representatives signing this agreement are aware that all of the competitors, staff and crew of this event have signed a model release as part of the Liability/Entry and Participation Waiver on the "Sign Up Page" This model release gives "Tow-In Surfers LLC" rights to the use of the images, voices and actions of all Competitors, Staff and Crew of the "6th Annual KEEP THE OCEAN BLUE North Shore Tow-In Surf Championship 2009/2010" for the Event's promotional purposes into perpetuity.
